Bankruptcy and Creditors Rights

We have an active commercial and consumer bankruptcy practice, both for creditors and debtors. The Firm serves as counsel to numerous financial institutions in protecting their rights as creditors in Chapter 11 and Chapter 7 proceedings and other insolvency situations and also regularly engages in helping financial institutions liquidate collateral through foreclosures and similar proceedings. We also counsel financial institutions and businesses in reorganizations, workouts and non-bankruptcy restructurings. We regularly serve as counsel to creditors in the enforcement of creditor rights and remedies arising from secured transactions including in-court and out-of-court enforcement actions.

We have served as lead counsel to debtors-in-possession and Unsecured Creditors Committees in Chapter 11 reorganizations. We recently served as debtor-in-possession counsel to a large convenience store operator which culminated in the sale of approximately 57 convenience stores in Tennessee and Virginia and which preserved some 350 jobs in the Northeast Tennessee and Southwest Virginia areas.
